Justice Ahmed Tijjani Badamosi of Kano High Court on Monday 17th February 2020, dismissed the suit by Kano Kingmakers challenging the creating four new emirates and appointment of first-class Emirs.
This latest development which was reported by the Kano State Government, a few months after a Kano High Court sitting in Kano on Thursday 21st November 2019, nullified the four new Emirates created in the state by Governor Abdullahi Ganduje.
Justice Usman Naába had in his judgment then averred that the creation of the new Emirates and appointment of four first Emirs was illegal. It was the second time that a court will be nullifying the creation of four new Emirates in Kano State, created by Governor Abdullahi Ganduje. This is so, because some interest groups since the creation and appointments of emirs in the new Emirates, have all instituted a legal action against the Government.
In 2019, a Kano State High Court sitting in Ungogo Local Government Area had declared that the appointment and the installation of the four new emirs by the Kano State government was null and void.
Four Kano Kingmakers that have the traditional legal powers to appoint new Emirs, after the announcement by the Governor, did not receive the action of the Governor wholeheartedly, prompting them to take legal action and calling for the nullification of the appointment.
Justice Nasiru Saminu, the Presiding Judge ordered a return to status quo pending the hearing of the suit against the appointment of the new Emirs.
The State High Court had on May 10th 2019 issued an exparte order restraining the Balkanisation of Kano Emirate and installation of new Emirs. But the Kano State governor, Dr Abdullahi Umar Ganduje issued the appointment letters and presented Staff of Office to the new Emirs against the subsisting Court Order.
Similarly, a House of Assembly member, representing Gwarzo constituency Hon Rabiu Mmuhammad Gwarzo had filed a suit challenging the creation of the new Emirates.
The Plaintiff was represented by his Counsel, AB Mahmud SAN, while the defendants were represented by Kano state Attorney General, Barrister. Ibrahim Muktar.
The defendants in the suit include the Governor Abdullahi Umar Ganduje, the Speaker, Kano State House of Assembly, Clerk of the Assembly, the Commissioner for Justice and Government Printer.
The four kingmakers are Madakin Kano, District head of Dawakin Tofa, Yusuf Nabahani; Makaman Kano, District Head of Wudil, Abdullahi Sarki-Ibrahim; Sarkin Dawaki Mai Tuta, District Head of Gabasawa, Bello Abubakar and Sarkin Ban Kano, District Head of Dambatta, and Alhaji Mukhtar Adnan Dambatta instituted the action.
All these had happened before this latest judgment, but no official statement confirming judgment allegedly given on Monday 17th February 2020.
But at the resumption of the trial on Monday, Justice Ahmed Tijjani Badamosi in his ruling said the suit has been overtaken by the event as the law creating the emirates has been quashed with the judgment of Justice Usman Na’aba on November 21 that nullified the creation of the emirates.
